(Effective Date:1977.01.01--Ineffective Date:) Article 1. The import and export of all articles for official use by foreign diplomatic missions in China and of all articles, through consignment shipping or by mail, for the personal use of diplomatic officers shall be subject to completion of Customs procedures at the Beijing Customs Office of the People's Republic of China. If the articles enter China through another port of entry, the procedures of Customs transit to Beijing shall first be completed through appropriate channels at the Customs office at the port of entry; if the articles leave China through another port of exit, the Customs procedures for export shall be completed in Beijing before their shipment to the port of exit. Article 2. The Declaration Form of Articles for Official or Personal Use Imported or Exported by Foreign Diplomatic or Consular Missions (hereinafter referred to as the "Declaration Form") shall be filled out in triplicate and submitted to the Beijing Customs Office by the foreign diplomatic mission concerned for completing the import or export procedures upon the arrival in Beijing of the inward articles referred to in Paragraph 1 or before the despatch of the outward ones. Number of pieces, descriptions and specifications, quantity, weight and value of the articles in question shall be declared on the Declaration Form, which shall be accompanied by such relevant papers as packing list and invoice. The articles in question shall not be delivered or despatched until checked and approved by the Beijing Customs Office. Filling in of the Declaration Form may be waived for non-registered small postal parcels, while an addressee or addressor shall show the Customs officer stationed at the post office his or her diplomatic identity card, against which such parcels, will be released for delivery or despatch. Article 3. The procedures provided for in Paragraphs 1 and 2 shall also apply to the above-mentioned articles for official or personal use brought into or out of China by the entrusted personnel from the diplomatic mission concerned. An application shall be filed with the Customs office for approval if for some special reason the articles are, as requested, carried personally by the entrusted person. For articles to be carried out of China, the Beijing Customs Office shall endorse the Declaration Form after the export procedures are completed in Beijing, and the Customs office at the port of exit shall release the articles against the Declaration Form endorsed by the Beijing Customs Office and for articles to be carried into China, the entrusted person shall first file an application for admission with the Customs office at the port of entry, and then complete the import procedures for clearance at the Beijing Customs Office upon arrival in Beijing. Article 4. Cars brought in for the personal use of diplomatic officers shall be limited to: Two for Ambassadors; and One each for other diplomatic officers. Cars brought in for the official use of a diplomatic mission shall be limited to a reasonable number. Article 5. A diplomatic mission which is to import radio receivers and transmitters and their principal parts in accordance with an inter-governmental agreement on the installation of radio stations shall first submit a written application in duplicate to the Ministry of Foreign Affairs of the People's Republic of China for verification and approval. The above articles shall be declared to the Customs upon importation and re-exportation. Article 6. Representatives and officers of a diplomatic mission who have brought in with them such articles prohibited for export as cultural relics and rare books, gold, platinum, silver and articles made thereof, precious stones and jewellery shall, within ten days after their arrival, submit a letter in duplicate to the Customs for registration; and those who have brought in the above-mentioned articles through consignment shipping or by mail shall declare them on the Declaration Forms, which shall be verified and endorsed by the Customs. They shall be released by the Customs for re-export against such registration and endorsement. Article 7. A diplomatic mission and its officers who are to transfer the ownership of duty-free articles shall first fill out in triplicate the Application Form for Transferring the Ownership of Articles for Official or Personal Use by Foreign Diplomatic or Consular Missions and then submit them to the Beijing Customs Office. Only after approval by the Customs, shall such transfer be legally effected. Except at the termination of a tenure of office or in some other special circumstances, the ownership of cars shall not be transferred until they have been used for two years after importation. Article 8. A foreign diplomatic mission in China shall send the following information in a letter to the Beijing Customs Office: 1 Five specimens, each including the mission's seal used for Declaration Forms, the signature of the Head of Mission and the signatures of at most two other diplomatic officers authorised by the Head of Mission. 2 Fifteen specimens, each including the stamp used for sealing diplomatic pouches and for diplomatic courier certificates. 3 A list of diplomats (including names and ranks). Any alterations in the above items shall be promptly notified to the Beijing Customs Office in writing. Article 9. A diplomatic mission which is to ship abroad goods purchased on the Chinese market for an organisation back home or for a mission of its own country in a third country shall first apply (with accompanying invoices) for an export licence from the Ministry of Foreign Trade of the People's Republic of China if the value of the goods is or exceeds RMB Y50. The mission shall fill out an Application for Release of Articles Not Subject to Licence and submit it to the Customs if the value of the goods is less than RMB Y50. The Customs will release such goods after checking them against the above-mentioned licence or permit. Article 10. Articles for official or personal use of a foreign diplomatic mission in a third country en route through China's territory shall comply with the procedures for transit goods and shall not be dealt with as articles for the official or personal use of a diplomatic mission in China. Article 11. When importing or exporting articles for official or personal use, foreign consular missions and their officers in China shall, in line with the present Regulations, complete the Customs procedures with the Customs offices in the cities where these missions are stationed. Article 12. The accompanied and unaccompanied baggage and effects of staff members of foreign diplomatic and consular missions, when taken into China at the begining of their tenure of office, shall be dealt with in accordance with the provisions provided for in the "Customs Regulations of the People's Republic of China Governing the Supervision and Control over Incoming and Outgoing Passengers' Baggage and Articles". A list of his or her inward unaccompanied baggage shall, however, be provided for the Customs office concerned within ten days after the owner's arrival. The inward unaccompanied baggage will be released duty free after checking and approval by the Customs office if it arrives within six months, otherwise it shall not be exempted from duty if it is not verified and approved by the Customs office or if it does not arrive within six months. Staff membrs who send articles for personal use into or out of China through consignment shipping or by mail during their stay in China shall pay duties in accordance with the relevant regulations. |
